COMMISSIONERS’ PROCEEDINGS        

          September 3, 2015

          Commissioners Doug Tucker, John Grewell, and John Prinkki were present.

      8:30 Pledge of Allegiance.

          Town of Bearcreek Mayor Jennifer Jessen and Clerk Jane Swanson Webb met with Commissioners to discuss Bearcreek water and sewer issues. Water line needs to be buried deeper because it may affect the County Road, Commissioner Tucker would be willing to help haul material to fix county road to keep it from washing out.

     Commissioner Tucker moved to accept meeting minutes as presented for August 13, 17, 20, and 24; Commissioner Grewell seconded; motion carried.

     Commissioner Tucker moved to accept District Court’s Fines and Fees Summary for August 2015; Commissioner Grewell seconded; motion carried.

     Commissioner Tucker moved to accept Treasurer’s Cash Report for August 2015; Commissioner Grewell seconded; motion carried.

     9:55 Road Superintendent Shawn Mains met with Commissioners regarding road maintenance issues.  

      10:00 Dan Martin met with Commissioners to sign Contract Superintendent of Schools Agreement. Treasurer/Superintendent of Schools Jane Swanson-Webb, Lori Kane, Luther School representatives Carrie Entenmann and Scott Heimer, and Elenore Gurrero Reporter Carbon County News were also present. Dan gave an overview of his history in the education system including being a teacher, coach, counselor, administrator, principal, and superintendent. He has also served as the Chief Operating Officer of the Billings School District, managed federal programs, and has worked on issues with the Montana Legislature. The only outstanding issue for the Agreement is Liability insurance; Dan is looking into alternative options to reduce the cost of the insurance. Attendants discussed the Luther School Board’s expectations of what the Contractor’s role would be with the school. Jane made a distinction between the duties of the Superintendent of Schools that her office will perform and the duties that require a specific certification per 20-3-207 (MCA), which Dan will perform under the Agreement. It was noted that the previous Superintendent of Schools performed duties for Luther School that are not required under Montana Law.

     Commissioner Grewell moved to accept Resolution 2015-14 to Adopt the Final Budget for Fiscal Year 2015-2016; Commissioner Tucker seconded; motion carried.

      Commissioner Tucker moved to accept the indigent burial claim for Frederick Arthur Haynes from Smith Funeral Chapels; Commissioner Grewell seconded; motion carried.

      11:30 John Husar met with commissioners regarding the Mud Springs Wind Project. Bren Moore was also present. John Husar reviewed the history of his correspondence with the Department of Fish Wildlife and Parks (FWP) regarding eagle migration. He noted that the site locations were selected based on FWP’s data collected in 2013. FWP performed a new count in 2015 with significantly higher counts that those performed by the Mud Springs Wind Project’s contractor. Commissioners agree that data needs to be validated.
