COMMISSIONERS’ PROCEEDINGS       

          January 21, 2016

          Commissioners Doug Tucker, John Grewell, and John Prinkki were present.

          8:30 Pledge of Allegiance.

          Commissioners received a letter from Rex Koch resigning from the Fair Board.

          Commissioners sent comments to the EPA regarding Forest Road Regulation under Docket ID No. EPA-HQ-OW-23015-0668 regarding Protection of Water Quality from Forest Road Discharges. Commissioners believe that the issue has been properly and adequately addressed through the State’s Best Management Practices. They do not believe it is necessary for the EPA to invoke regulatory authority over forest roads and storm water runoff.

          9:00 County Attorney Alex Nixon met with Commissioners regarding the Deputy County Attorney contract for Civil legal services with Doney Crowley PC. Former Deputy County Attorney Jacque Papez was also present; she will be the primary attorney performing services under the contract. Commissioner Grewell moved to approve the contract for Deputy County Attorney Civil; Commissioner Tucker seconded; motion carried.

Alex noted the County and other Defendants/Appellees in the Silvertip Zoning suite have filed their responses. Plaintiffs/Appellants have 14 days to file their reply unless an extension is granted.

          Commissioner Grewell moved to approve early claim check run for January 2016; Commissioner Tucker seconded; motion carried.

          9:30 Fee Schedule Review. Debbie Brown and Samantha Long from the Museum met with Commissioners to discuss Historical Evaluation Fee. They believe that the review fee minimum of $200 is too high would like to reduce it to $75/hour for design review, with a $200 minimum for Subdivisions and Cell Towers. They also discussed possibly creating a varied fee structure for different services the office provides. Commissioner Tucker moved to change Historic Evaluation fee to $75 /hr with a $200 minimum for cell towers and Subdivisions; Commissioner Grewell seconded; motion carried.

          Cattle Guard standard length was increased to 24’ (Resolution 2015-15) which requires more metal and materials. Commissioner Grewell moved to increase the Cattle Guard Installation Fee to $3,400.00; Commissioner Tucker second; motion carried. Commissioner Grewell noted three recent cattle guards requests were quoted at the old fee of $2,850; those quotes will be honored.                                                                                                                       

Commissioner Grewell moved to add Sanitarian fees for Temporary Food Service Permits at $85/year and Cottage Food Operation Registration at $40 (one-time fee); Commissioner Tucker second; motion carried.

           Commissioner Grewell moved to accept the Morrison-Maierle Systems Corporation Courthouse On-Site/Off-Site Back Up Services Agreement; Commissioner Tucker seconded; motion carried.

          10:00 Clerk and Recorder Marcia Henigman met with Commissioners regarding tax deed sale. Tim McCloy and Don Dell participated via phone. Bret Barney representing Sunlight Ranch, Sarah Ewald, and John Stampfel were also present.

          South 1/2 of Lot 8, Block 1, of Campbell Addition to Bridger, Carbon County; $2,000 minimum: no bids received.

          S01, T08 S, R20 E, Personal Property in Washoe House #115, no real property; $520.01 minimum: Bret Barney/Sunlight Ranch bid minimum of $520.01.

          A parcel of land lying between Tract 2 of COS 1291 and Track A of Cos 1282 Amended approximately 34.89 feet wide and 331.75 feet long connecting Tract 3 of COS 1291 Amended with US Hwy 212, all as reflected on COS 1291 Amended; minimum $1,000.00: Sarah Ewald bid minimum of $1,000.00

          Bridger property can be noticed for public auction again with lower price; if no bid is received at that time the County has the option to enter into private sale.

          Commissioner Grewell moved to accept bids from Bret Barney/Sunlight Ranch on Washoe House #115 and Sarah Ewald on property reflected on COS 1291 Amended; Commissioner Tucker seconded; motion carried. 

          10:20 Danny Mydland met with Commissioners to discuss the fair maintenance position and the FFA Representative acting as a voting member on the Fair board.

          10:30 Commissioners participated in MACo Property & Caualty Trust annual renewal webinar.

          Commissiones tabled the Bid award for the East Pryor Road Bridge as the State has not yet approved the TSEP contract.

          12:00 Board of health meeting. Bill George, Dick Nolan, Roberta Cady, Jean Atherly, Tom Kohley, and Josh Juarez were present. Commissioner Tucker moved to approve the October 15, 2015 Board of Health Meeting Minutes; Commissioner Grewell seconded; motion carried.
