Commissioners Scott Blain, Bill Bullock and Scott Miller; Administrative Officer Angela Newell; and Commissioners’ Secretary Barbara Krizek were present.

8:30 Pledge of Allegiance.

Discussion regarding whether to enter into Stage 1 Fire Restrictions. There is an on-going fire in Robertson Draw that is on Forest Service land; Commissioners concurred that they would like to continue to monitor conditions and defer decision at this time.

Sanitarian Cortney Lynde announced that she will be resigning her position in August.

9:00 Industrial Communications and Electronics Settlement Recommendation. Contract Deputy County Attorney Jacque Papez detailed the terms which agreed upon by the County and the defendents: Industrial Communications will pay the County $425k upfront and then $225k in payments over 7 years. If they default on payments, the County will be owed the full $1.1M. Papez will insist upon indemnification language to protect the County regarding litigation between Industrial Communications and BlueWave. Commissioner Miller moved to postpone the Industrial Communications and Electronics Settlement recommendation to Tuesday June 22 when the final term sheet has been supplied for signature; Commissioner Blain seconded; motion carried.

Commissioner Blain moved to approve Commissioner Proceedings for May 20 and 25; Commissioner Miller seconded; motion carried.

10:00 Request for Qualifications (RDQ) for Detention Facility Architects. Attended by Owner’s Representative Shane Swandal of Hulteng CCM. Commissioner Blain moved to approve the RFQ for Architectural/Engineering Services for the Carbon County Detention Center; Commissioner Miller seconded; motion carried.

Discussion regarding the use of the upcoming Industrial Communications settlement and where to allocate those funds; decision to pay off Radio System and Computer Aided Dispatch leases and to allocate to Communications Capital Fund.

10:00 Resolution for Distribution of Bridge and Road Safety Accountability Act (BARSAA) Funds. Commissioner Blain moved to approve Resolution 2021-13 Requesting Distribution of Local Government Road Construction and Maintenance Match Program Funds; Commissioner Miller seconded; motion carried.

10:10 Meeting closed to discuss a personnel issue. Disaster and Emergency Services (DES) Coordinator Cyrina Allen in attendance.

10:25 Meeting re-opened. Allen provided an update on current conditions on the Robertson Draw fire which is listed as a Type 2 Incident. The fire is expected to grow to 15,000 acres by the close of today. Gold Creek and Ruby Creek are on mandatory evacuation; Grove Creek is on stand-by; pre-evacuation warnings issued for affected properties along the Rock Creek drainage.

10:45 Blain and Miller departed the meeting.

Fire Warden Tom Kohley provided his update on the Robertson Draw fire. Commissioner Bullock and Kohley confirmed roles and responsibilities between Fire Warden and DES.

11:00 Commissioner Miller re-joined the meeting. 11:10 Commissioner Bullock departed the meeting; adjourned.

16:30 Commissioners Miller and Bullock provided verbal approval of Resolution 2021-14 Carbon County Disaster Declaration (Fire) and Resolution 2021-15 Carbon County Stage I Fire Restrictions. They were away from the office responding to the on-going Robertson Draw Fire.
